At the Senate meeting held on August 2, 1971 I
said I would obtain legal advice on the following points relating to
the library loan policy.
1.
Could Senate levy the proposed fines and
follow-up actions, or is the approval of the
Board of Governors required? and
2.
What authorization is needed to use a
collection agency for fines?

With respect to the question of Senate-Board
jurisdiction, the essence of the attorney's opinion was that the
ambiguities that might surround the "fees" in section 46 (h) of
the Universities Act would be removed if the Senate paper was
approved by the Board.
The exception to the above, is that aspect dealing
with the collection agency. The attorney advised that Senate does
not have the power to authorize the use of a collection agency, but
that the Board does.
The Board at its meeting held on August 26, 1971
approved the library loan policy as it passed Senate, with the
exception of the amendment relating to fines. On this point, the
Board of Governors authorized the President to utilize a collection
agency for the recovery of unpaid library fines.
