matics Graduate Requirements. These revised
Mathematics Graduate requirements were approved
by the Executive Committee of the Senate
Graduate Studies Committee meeting on
July 22, 1974.

The following is the Motion for Senate which came to us
from the Mathematics Department through the Faculty of Science
and was held over until the following meeting:
MOTION: That the "degree requirements" for the MSc and Ph.D.
in Mathematics be revised to read as follows (the
current requirements are given
on pp.
131-132 of the
1974-75 Calendar):
Degree requirements
A candidate for the M.Sc. degree will normally be required
to obtain a total of at least 20 semester hours of credit

for course work beyond courses taken for the Bachelors
degree. Of these 20 hours at least 12 are to be in graduate
courses or graduate seminars and the remaining 8 may be
chosen from graduate courses or graduate seminars or 400-
level undergraduate courses excluding Math 491-494. He
will also be required to submit a satisfactory thesis and
to attend an oral examination based on that thesis and
related topics.
A candidate for the Ph.D. degree will generally be required
to obtain at least 28 semester hours of credit for course
work beyond courses taken for the Bachelors degree. Of these
28 hours at least 16 are to be in graduate courses or graduate
seminars and the remaining 12 may be chosen from graduate
courses orgraduate seminars or 400-level undergraduate
courses excluding Math 491-494. The course work will in
all cases involve study in at least four different areas of
Mathematics, at least one of these areas being in Analysis
(Applied, Complex or Real). Applied Analysis is understood
to include Differential and Integral Equations and Methods
of Applied Mathematics.
Candidates for the Ph.D. degree will normally be required
to pass a general examination. This shall consist, at the
the option of the candidate's Committee, either of written

papers in four areas of study or of written papers in three
areas of study and graduate course work in an approved fourth

area in which a grade of 'B' or higher is obtained. In
either case one of the written exam areas must be in Analysis
(Applied, Complex or Real). candidate will not ordinarily
be allowed to take the general examination more than twice.
Students will be interviewed and advised regarding appropriate
courses and examination curricula. Course programs and
examination programs require Departmental approval.
Rationale
This would introduce more flexibility into the programs.

A copy of the new Universities Act is enclosed for the
information of members of Senate. We have been informed that
Sections
1 - 90
inclusive were proclaimed July
4, 1974.
2.
The Chairman of Senate sought legal opinion concerning
two sections of the new Act, namely Section
4(4)
and Section
4(8)
pertaining to membership on the Board and on Senate, and pertaining
to rules, regulations, etc. A copy of the letter of enquiry to
the legal firm is attached
The legal opinion to each of the two enquiries is
affirmative.

Today I was informed that on July 4, 1974 sections 1 through
90 inclusive of the new Universities Act were proclaimed and that
these sections came into
force
on July 4th.

Two of these sections are sections 4(4) and 4(8). Section 4
(4) provides:
"Notwithstanding any other provision of this Act, a member
of the board or of the senate of a university holding -
office immediately prior to the commencement: of this Act
shall continue to hold office until a date fixed by order
of the Lieutenant-Covenior in Council and the composition
of the board and senate remains as provided in the former
Act until a date fixed by order of the Lieutenant-Governor
in Council."
and section 4(8) provides:
"Unless inconsistent with this Act, or rules, regulations,
and by-Jaws made under this Act:, the rules, regulations,
and by-laws of any body established or continued under the
former Act in force inmediatcly prior to the commencement
of this Act continue in force until amenc.lecl or repealed
by the same or a similar body under this Act."
Furthermore, on July 3rd the government asked existing Board
members to continue to act in their full capacity as Board members
under section 4(4) , and asked existing Senate members to continue
to act in their full capacity as Senate members under section 4(4)

Given these facts, it is my interpretation that (1) the present
Senate can pass rules, including election rules, which would come
into effect upon passage, and (2) that elections to Board and Senate
could be held under these election rules subject to the proviso that
the persons elected would take office on the date fixed by order of
the Lieutenant Governor in Council as provided for in Section 4 (4).
Is this interpretation correct? If not, please advise as to
a proper interpretation.
