At the March 25, 1980 meeting of our Board of Governors,
approval was given to the procedures to be used in identifying
a suitable candidate for the position of Associate Vice-President,
Academic. These procedures which were approved made no provision
for a ratification vote to be taken by regular, full-time faculty.
These procedures were then forwarded to Senate for approval, as
required in Section 28 (e) of the Universities Act, as follows:
Powers of 28. Subject to the powers of the Universities
Board ?
Council, the management, administration,
and control of the property, revenue,
business, and affairs of the university
are vested in the board, and, without
limiting the foregoing or the general
powers conferred upon or vested in the
board by this Act, the board has power
(e) with the approval of the senate,
to establish procedures for the
recommendation and selection of
candidates for president, deans,
librarians, registrar, and other
senior academic administrators
as the board may designate.
As you are aware, Senate at its regular meeting on
April 14, 1980, elected to amend the proposed procedures
through the inclusion of ratification procedures. The legality
of such an amendment aside, the amended procedures were further
considered by our Board at its meeting on April 22, 1980. In
addition to considering the wishes of Senate on this matter,
the Board heard arguments on behalf of the Faculty Association
in support of the ratification provision. After considerable
discussion on this matter, the Board, by majority vote, defeated
inclusion of a ratification procedure of the candidate, thereby
retaining the procedures of the original proposal as submitted
to Senate for approval.
Clearly, the Board of Governors has no desire to assume a
position of confrontation with Senate. However, the Board
does feel it has sound reasons for the action which it proposes
and I will attempt to elaborate on them at our meeting on
May 12, 1980. In the meantime, I would like to remind Senate

of the necessity to move ahead with this appointment as soon
as possible. In this regard, I urge you to consider seriously
the need to approve the procedures submitted for consideration
by the Board of Governors.

MOTION: "That Senate approve the proposed Search Procedure
for Associate Vice-President, Academic, as follows:
1. Search Committee Composition
Chairman -Vice-President, Academic
2 Deans - selected by the Deans
3 faculty - elected at large
President, Faculty Association, or his designate
2 students - appointed by Student Forum
2. Terms of Reference:
a)
To recommend to the President a candidate to be
appointed Associate Vice-President, Academic,
if possible effective September 1, 1980.
b)
The search is to be limited to current faculty
members at Simon Fraser University.
c)
The Committee is expected to undertake an
active search for candidates.
d)
The Committee's deliberations shall be
confidential and shall be conducted according
to the rules of procedure for Senate committees.
A decision on recommendation to the President
of a candidate for appointment shall be made
by majority vote.
e)
If the President does not find it possible to
recommend to the Board of Governors the
appointment of the candidate recommended by
the Committee, the Committee shall undertake
once more the responsibilities outlined above."
