At its October 5, 2005 meeting SCUP reviewed and approved the draft terms of
reference for the SimonsFoundation International Endowment Fund.
Motion
That Senate approve the draft terms of reference for the Simons Foundation
International Endowment Fund.
Rationale
This fund will support the Simons Visiting Chair in Dialogue on International Law and
Human Security, and the Chair in International Law and Human Security. Together,
these chairs will provide a public face to important intellectual, teaching and community
outreach traditions at SFU. Further details about the objectives of the Chairs are
provided in the attached documentation.
The terms of reference have been reviewed for consistency with applicable university
policies, and have been reviewed by a representative of the Simons family.

Terms of Reference
Overview
The Simons Foundation International Endowment Fund will be established at
Simon Fraser University by the Simons Foundation of Canada, in partnership with Simon

Fraser University. The Fund will support the Simons Visiting Chair in Dialogue on
International Law and Human Security and the Chair in International Law and Human
Security.
Together, these Chairs will provide a public face to important intellectual, teaching
and community outreach traditions at Simon Fraser University.
The Simons Foundation of Canada agrees to donate $2 million (CAD) to the
Simons Foundation International Endowment Fund and the annual income from its $2
million donation will be used to fund the Simons Visiting Chair in Dialogue on
International Law and Human Security, henceforth referred to as the Simons Visiting
Chair in Dialogue.
The Chair in International Law and Human Security will be funded by a
combination of the annual income from $2 million provided by the Burnaby Mountain
Endowment Fund Matching Program, as a match for the $2 million donation from the
Simons Foundation of Canada and the equivalent of a base funded position (assistant
professor step 4) provided annually by the Faculty of Arts and Social Sciences.
Purpose and Objectives

The Simons Visiting Chair in Dialogue will enhance understanding and raise the
public profile of key international issues that affect the welfare and well being of present
and future generations and promote public debate with respect to these issues.
The Chair in International Law and Human Security will work with the Simons
Visiting Chair in Dialogue on community outreach activities, including coordinating an
Annual International Conference on Issues in International Law and Human Security (to
be held at the Morris J.
Wosk.
Centre for Dialogue).
Additionally, the Chair in International Law and Human Security will carry out a
program of research that will focus on the role of international law as a critical factor in
preserving and promoting peace, human rights and human security, broadly defined.
Simons Visiting Chair in Dialogue on International Law and Human Security
Advisory Committee
The advisory committee will be chaired by the Dean of Arts and Social Sciences
and include three faculty members from the Faculty of Arts and Social Sciences, one
member from the board of the Simons Foundation of Canada and one member from the
community who is not directly associated with Simon Fraser University. The advisory
committee will provide advice to the School for International Studies Appointments
Committee on candidates for the Simons Visiting Chair in Dialogue.

Chair in Dialogue on International Law and Human Security

Simon Fraser University will appoint the Simons Visiting Chair in Dialogue. The
term of this appointment is a minimum of four months to a maximum of one year, on a
limited term basis. The compensation will be the equivalent of the salary of an associate
professor or professor. The appointment shall require the approval of the School for
International Studies' Tenure and Promotion Committee. Prior to advancing a nomination
under university policy AlO.06 (Appointment of Specially Funded University Chairs,
University Professors and Research Fellows), the School for International Studies
Appointments Committee will consult with the Simons Visiting Chair in Dialogue on
International Law and Human Security Advisory Committee. ?

Visiting chair holders will be leading figures with diverse backgrounds -including,
but not limited to, the sciences, humanities, diplomatic corps. politics, non government
organizations and academe - who demonstrate, through their work and/or writing, a
commitment to improve understanding and promote dialogue on issues in International
Law and Human Security that impact the welfare and well-being of present and future
generations. The visiting chair holder will be situated in the School for International
Studies in the Faculty of Arts and Social Sciences at the SFU Vancouver campus. The
visiting chair holder will play a key role in enhancing public awareness of international
issues by holding public forums in conjunction with the Morris J. Wosk Centre for

Dialogue. The visiting chair holder will have access to the administrative support and
research resources of the Chair in International Law and Human Security. The teaching
load of the visiting chair holder will be negotiated but normally will be a minimum of one
course and a maximum of two depending upon the length of the appointment.
Chair in International Law and Human Security
Simon Fraser University will appoint the Chair in International Law and Human
Security. The term of this appointment is

years and is renewable. The applicable policy
is A10.06. Appointment and renewal processes will follow the policy.
Simon Fraser University will appoint to a tenure track position at the rank of
associate professor or professor, a candidate who specializes in one or more of the
following areas: international law and international relations, international criminal law,
studies in war crimes and the international courts and international organizations. The
intent is to appoint a candidate who will concentrate on teaching and research on
international relations, international law and international criminal justice as the
foundation for human security.
The Chair will be situated in the School for International Studies in the Faculty of
Arts and Social Sciences at the SFU Vancouver campus and will encourage and develop
linkages with other departments, institutes and universities in order to promote
interdisciplinary research and integration in this new field.
As a critical member of the School for International Studies, the Chair will be
expected to create new curriculum on international law and human security, to conduct a
coherent program of research and to foster broader public understanding of the issues
through conferences and symposia. The teaching load of the Chair will normally be
50%
of the normal teaching load in the School for International Studies.
Fund Administration
The Simons Foundation International Endowment Fund will be held by Simon Fraser
University. The administrator of the Fund will be the Vice President - Academic, or his/her
designate. Donations to the Endowment may be received through Simon Fraser University.
The capital of the Endowment Fund will be held in perpetuity with a portion of annual
earned income reinvested in the Endowment to protect its value over time. The annual earned
interest income (see Endowment Management Policy GP 20) will also be used to support the
salary, benefits and related activities of the Simons Visiting Chair in Dialogue and the Chair in
International Law and Human Security, including teaching, research and community outreach
activities.

In the event that circumstances make the specified use of the Endowment Fund no longer
practicable or desirable, the Board of Governors of Simon Fraser University is hereby authorized

to make any changes it may deem necessary in the terms or use of the Endowment Fund after
consultation with the Simons Foundation of Canada. Such changes, however, are to be in
keeping as far as possible with the original spirit and general intent of the Endowment Fund. This
agreement may be amended by mutual consent of The Simons Foundation of Canada and Simon
Fraser University.
